These Terms of Service (“Terms”) govern your use of the services provided by WHIPPEDCO LTD, a private limited company registered in England and Wales with Company Number 16577955, and registered office at 61 Ernest Road, Hornchurch, England, RM11 3JN (“we”, “us”, “our”). Our nature of business is defined by SIC code 56103 (Take-away food shops and mobile food stands). By placing an order, using our website (whippedcoltd.shop), or engaging with our services, you (“you”, “your”) agree to be bound by these Terms, our Privacy Policy, and all applicable laws and regulations. Orders
When you place an order through our website or by phone, you are making a legally binding offer to purchase our food and delivery services. We reserve the right to accept or refuse your order at our discretion, including but not limited to cases where: items are out of stock, delivery to your location is not possible, we suspect fraudulent activity, or we are unable to fulfill the order for any other legitimate reason.
Your order is confirmed once we have acknowledged it via email or phone, and we begin preparing your food. We will provide you with an estimated delivery time at the time of order confirmation. The minimum order value for delivery is £15 (GBP); orders below this value will not be processed for delivery, though collection may be available at our discretion.
We reserve the right to limit the quantity of any item per order, particularly for limited-stock items, and to correct any errors in order details (e.g., incorrect item selection, quantity) by contacting you before preparing your order.
Prices & Charges
All prices displayed on our website and in our order system are in Great British Pounds (GBP) and include Value Added Tax (VAT) where applicable, in compliance with UK tax regulations. Prices are subject to change without prior notice, though we will always display the current price at the time you place your order.
A delivery fee of £2.99 (GBP) applies to all orders. Free delivery is offered on orders with a total value of £30 (GBP) or more, excluding the delivery fee. Additional charges may apply for special requests (e.g., extra condiments, specific packaging) or during peak periods (e.g., public holidays, weekends), which will be clearly stated at the time of order.
We reserve the right to correct any pricing errors, even after an order has been placed, if the error is obvious and significant. In such cases, we will contact you to confirm whether you wish to proceed with the corrected price or cancel the order without charge.
Payment
We accept the following payment methods: Visa, Mastercard. All card payments are processed through a secure, encrypted payment processor, ensuring your payment details are protected at all times. We do not store, access, or process your full card details, in compliance with strict data protection and payment security standards.
For card payments, your payment will be authorized at the time of order placement to ensure sufficient funds are available. If payment authorization fails, we will contact you to request an alternative payment method. For cash on delivery, exact change is appreciated, as our delivery drivers may not always have sufficient change available.
We reserve the right to refuse any payment method at our discretion, including cases where we suspect fraudulent activity. In such cases, we may cancel your order and notify you accordingly.
Delivery
We deliver to the following areas: Hornchurch, Romford, Upminster, Dagenham, Harold Hill, Elm Park, Rainham, and surrounding East London & Essex areas. We do not deliver outside of these stated areas, and any orders placed for delivery outside our service area will be refused or canceled.
We aim to deliver all orders within 45-60 minutes of order confirmation. However, delivery times may vary due to factors beyond our control, including peak periods (e.g., dinner time, weekends, public holidays), traffic conditions, weather, and order volume. We will notify you if we anticipate a significant delay (more than 15 minutes beyond the estimated time).
If our delivery driver is unable to reach your address (e.g., incorrect address, no access to the property, no one available to receive the order), we will attempt to contact you via phone. If we are unable to reach you after 3 attempts, we may return the order to our kitchen and consider the order fulfilled, with no refund provided. It is your responsibility to provide an accurate delivery address and contact details.
Food quality is guaranteed at the time of delivery. We are not responsible for any deterioration in food quality if the order is not collected promptly upon delivery, or if the order is left unattended after delivery.
Cancellations & Refunds
You may cancel your order and receive a full refund if you contact us before food preparation has begun. Once food preparation has started, we cannot cancel the order or provide a refund, as ingredients have been used and resources have been allocated to fulfill your order.
To cancel an order, please contact us immediately via phone (+44 7878 503661) or email (hi@whippedco.co.uk), providing your order number and contact details. We will confirm the cancellation and refund (if applicable) within 24 hours. Refunds will be processed using the same payment method used to place the order, and may take 3-5 working days to appear in your account, depending on your bank or payment provider.
We reserve the right to refuse a refund if we have evidence that the order was delivered correctly and in good condition, or if the cancellation request is made after food preparation has started. In cases of exceptional circumstances (e.g., food contamination, incorrect order delivered), we may offer a replacement order or a partial/full refund at our discretion.
Complaints
We strive to provide high-quality food and service, and we take all complaints seriously. If you have a problem with your order (e.g., missing items, incorrect items, poor food quality, late delivery), please contact us within 2 hours of delivery, providing your order number, contact details, and a clear description of the issue.
We will investigate your complaint promptly and respond within 24 hours. Depending on the nature of the complaint, we may offer a replacement order, a partial or full refund, or a credit note for future orders, at our discretion. We reserve the right to request evidence (e.g., photos of the order) to support your complaint.
If you are not satisfied with our response to your complaint, you may escalate the matter to the Citizens Advice Bureau or the relevant consumer protection authority in the UK.
General Terms
- We reserve the right to modify these Terms at any time. Any changes will be posted on our website, and your continued use of our services after the changes are posted constitutes your acceptance of the modified Terms.
- We are not liable for any indirect, incidental, or consequential damages arising from your use of our services, including but not limited to loss of enjoyment, inconvenience, or missed events.
- You agree to provide accurate, up-to-date information when placing an order or contacting us. We are not responsible for any errors or delays caused by incorrect information provided by you.
- Our services are intended for personal use only. You may not resell, redistribute, or use our food or services for commercial purposes without our prior written consent.
- These Terms are governed by the laws of England and Wales, and any disputes arising from these Terms will be subject to the exclusive jurisdiction of the courts of England and Wales.
